1. Our service and these terms

Cheriby creates custom digital desktop pets from pet photos and selected animations. By using the service or placing an order, you agree to these terms and our Acceptable Use Policy. For support or questions about the operator of the service, contact support@cheriby.com.

2. Prices, payment and delivery

Purchases are one-time payments with no automatic renewal. The Starter Package costs US$6.90 and includes one custom digital desktop pet with three starter animations. Additional standard animations cost US$1.00 each and advanced animations cost US$2.00 each. Any applicable taxes and the final total are shown before payment. See Pricing.

The animations, currency, amount and delivery items in your final order review apply to that order. Payment details are processed by the provider identified at checkout. Completed files are delivered digitally through your account for use with compatible Cheriby desktop clients. Compatibility and current download availability are shown on the website.

3. Your uploads and permissions

Upload only pet photos and other material that you own or have permission to use. Do not upload another person’s photos or voice without their permission. You remain responsible for the rights in your inputs and for your use of the delivered files. Do not submit confidential information that is unnecessary for creating your pet.

Your uploads remain yours. You grant us a limited permission to process your inputs and generated files to provide creation, delivery, recovery and support. We do not claim ownership of your original photos. AI outputs may resemble other outputs and may not qualify for exclusive intellectual property protection.

4. Prohibited content and misuse

You must not upload, request, generate or distribute pornography or sexually explicit/NSFW material; graphic violence or gore; hate speech; child-unsafe material, including child sexual abuse material (CSAM); deepfakes or impersonation; or content that infringes copyright or trademarks. These categories and our reporting and enforcement process are described individually in our Acceptable Use Policy.

Do not use generated assets for illegal purposes, impersonate others, interfere with the service, or access another customer’s account or files.

5. Violations, suspension and appeals

We may refuse a request, withhold or remove violating content, restrict an affected feature, or suspend or terminate an account for misuse. We consider the nature, severity and repetition of the violation. Where appropriate and legally permitted, we explain the action and allow an appeal through support@cheriby.com.

A policy investigation does not create an automatic right for us to confiscate a payment. Affected paid orders are reviewed under our refund policy and applicable law. We preserve the order record needed for support, recovery and any required refund.

6. AI models and service providers

Pet images and keyframes are generated using OpenAI GPT Image 2, and animation videos using ByteDance Seedance 2.0 Mini, accessed through APImart. Cheriby is an independent product and is not affiliated with or endorsed by OpenAI, ByteDance or APImart.

AI may produce unexpected or inaccurate details, and matching a pet’s appearance or a requested movement is not guaranteed.

7. Availability, failed jobs and refunds

Service can be interrupted by maintenance, provider outages or technical faults. Completion times are estimates rather than guarantees. We may pause creation for a reported policy violation, quality or recovery. A delay or interrupted job does not require you to buy the same order again.

If a system failure interrupts creation, we recover the original paid order at no additional charge. If we confirm that we cannot deliver your paid order, we will issue a full refund for that order. Dissatisfaction after delivery is reviewed individually. See our Refund policy.

8. Disclaimers and limits of responsibility

Except for our express delivery and refund commitments and rights required by law, the service and AI-generated results are provided as available, without a promise of uninterrupted access, error-free generation, a particular visual result or fitness for a particular purpose. You are responsible for deciding whether a result is suitable for your intended use.

To the extent permitted by law, we are not responsible for indirect or consequential loss caused by use of the service, such as lost profits, business opportunities or expected savings. Our aggregate liability for a claim connected to a paid order is limited to the amount paid for that affected order. These limits do not exclude liability that cannot lawfully be excluded, including applicable mandatory consumer rights, fraud or wilful misconduct, and do not reduce our stated refund commitments.

9. Privacy, changes and contact

Our Privacy policy explains processing and your data rights. Material changes to these terms will be identified on this page and, where required, communicated to affected customers. Changes do not retrospectively remove the delivery or refund terms of an existing paid order. Contact support@cheriby.com for questions, complaints or appeals.
